Sub: Guideline on FSSAI order dated 13/01/2023 on the following matters.

1. Manufacturers [including Repacker and Relabellers] to upload or link mandatory Lab Testing
Report [Six-monthly] on FoSCoS-reg.
2. Renewal of Food Safety License on or before one month of expiry.
3. Filling of Return within 30th April [One month beforethe last date i.e. 31st May] every year.
4. FOSTA training to all Manufacturers, Repacker and Relabellers.

Dear Members,
STTA members Sri GangadharNakipuria (President), Sri Trilok Chand Agarwal (Immediate
• PP)and Sri Harish Kumar Agarwal (Secretary) had a meeting with the Authorities of FSSAl, Darjeeling district on dated 7th February, 2023 (Tuesday) at the board room of STTA. Discussion took place on the three points mentioned in subject line.
1. As per FSSAI Conditions of License number 12 of Schedule 2 of FSS (Licensing and Registration) of Food Businesses, 2011 and further FSSAI clarification on the frequency of the mandatory biannual testing of food products vide order No. 15(31)2020/FoSCoS/RCD/FSSAI dated 8th July,2021Food Business Operators shall have toensure testing of relevant chemical and/or microbiological contaminants in food products in accordance with the regulations as frequently as required onthe basis of historical data and risk assessment to ensore production and delivery of safe food through own or NABL accredited/FSSAI notified labs at least once in six months.
The last date for uploading/linking of the six-monthly lab test report for the period April 2022 to September 2022 is 31sMarch 2023. Thereafter, Food Business Operators should ensure that uploading/linking of the six-monthly lab test report is done on FoSCoS within one month from the closing date of respective half yearly period i.e by 31s October for the period of April to September and by 30th April for the period of October to March.
2. Licenses of the food businesses should be renewed one month before expiry.
Queries relating to License/Registration should be raised online only as FSSAI does not contact applicant over telephone. Complaints may be reported at helpdesk no. 1800110100 and at foscos@fssai.gov.in.
In case queries received from authorities on application, applicant should respond within 30 days to avoid rejection of application by login into FSSAI Food Safety Compliance System (https://foscos,fssai.gov.in) with applicant’s user Id and password or he can call at 1800112100 for any clarification.
Applicant must keep a copy of Form B (application) for any kind of communication with the authorities till obtaining License.
Applicant is
advised to provide his registered mobile no. to get the notifications over his
application.
GST applicability on this transaction is on reverse charge basis.
3. Filling of Annual Return [Form “D-1”] by the food businesses for FY 2021-22 and 2022-23 should be completed immediately and Penalty (if any) @ Rs.100/- per day for non-filling of Returns should be paid immediately.
For transparency and to ease out the filing of Annual Returns by the food businesses at the end of the financial year, Food Authority has mandated that all Manufacturers [including Repacker and Relabellers] shall, through FoSCoS, either upload six monthly lab testing reports as per Condition of License number 12 [as per the frequency defined in above mentioned FSSAI order] or link such lab reports from the InFoLNet wherever the samples are analyzed by FSSAI notified labs.
Accordingly, all Manufacturers [including Repacker and Relabellers] are advised to upload/link the lab reports w.e.fFY 2022-23.

4. As per FSSAI norms FOSTAC training is mandatory to all Manufacturers, Repacker and Relabellers. STA is thinking to conduct a Seminar on the same at STTA Building for all.

SUB: E-WAY BILL COMPLIANCE – COLLECTION OF GOODS FROM WAREHOUSES FOR FURTHER TRANSPORTATION.

Dear Members,
This is to bring to your kind notice that on 01/11/2022 transporter’s vehicle carrying collection teas from different warehouses corresponding to few of our Buyers to its Depot was detained by the GST
Officials stating non-compliance of GST E-Way Bill Rules 138(3).
Subsequent to which our Association, STAC, TIPA and Transporter’s Association jointly had a meeting with GST Officials on 03/11/2022 at their office to sort the above matter and discuss the best possible operational method for smooth running of the trade.
The detailed outcome of the meeting for E-Way Bill Rule 138(3), the compliance is – Part A of FORM GST EWB-01 in the name of the respective transporter with his registered ID is mandatorily required to be generated before collection of goods for farther shipment.
Hence our Buyer member has to comply mandatorily with the followings to avoid penalties under
GST Law:
1. When Goods are in movement with the involvement of the Transporter – Buyer (Supplier as referred to in GST Law) has to send Tax Invoice and Part A of FORM GST EWB-01 (can be in digital mode) in the name of the Transporter along with delivery order.
2. When Goods are in movement without the involvement of the Transporter – Both Part A and Part B of FORM GST EWB-01 is mandatory. Also to note that vehicle number should cautiously be mentioned while generation of E-Waybill as any mismatch in the same will attract penalties as in case no Waybill generated.
Hence request all members to seriously look into the matter and adopt the above procedures for the smooth operation of Trade.
